Draft Decision Delivered from the Fair Trade Commission


A draft decision on the hearings in which JASRAC had requested the cease-and-desist order on the royalty collection method in the field of broadcasting to be rescinded was delivered today from the Hearing Examiners of the Fair Trade Commission.

The draft decision concludes that the cease-and-desist order shall be rescinded, the outline of its reason being that as there is no evidence to acknowledge that the aforementioned royalty collection method has the effects of rejecting the business activities of other copyright management organizations, violation of Article 3 of the Antimonopoly Act could not be recognized.

JASRAC believes that an appropriate decision was made in line with its claims and presentation of evidence made during the hearings.

As this is still a draft JASRAC cannot give any details; however comments will be presented once the final decision is made.
